How do we protect our child ....when the judicial system wont?

Custody battle... we are trying to get custody of my fiance's 10 yr old daughter. Her mother is bi-polar (6 different med's and if not taken is a Crazy person),a drug user (found guilty in a drug test) constantly demeans my fiance in front of child. Has moved 5 times in 1 year and 3 different schools. Has been arrested for Domestic violence and has had violence in front of the daughter. Now mother is reporting child molestation to try to stop the court case and visitation. We have a guardian ad litem and a good attorney that knows she is nuts but no one is protecting the child. The mother is alienating the child and emotionally battering her...... Now they tell us our new court date is in January because psychological testing has to be done- we have been going through this since February already. The safety and well being of this child is in jeopardy and the system is not protecting her. How do we get the system to work for us. I feel we have no rights and she has them all.
